Droplet Troubleshooting Agent Terms and Conditions - Private Preview

1. Acceptance of Terms

By opting in to use the Droplet Troubleshooting Agent, you agree to these additional terms and conditions related to the Private Preview program, which supplement the DigitalOcean Terms of Service.

2. Description of the Private Preview Program

Droplet Troubleshooting Agent leverages large language model (LLM) technology to provide insights into infrastructure-level Droplet issues by analyzing Droplet logs, metrics, and system metadata. Droplet Troubleshooting Agent will recommend changes that may enhance the performance and reliability of your Droplets. You will need to review those recommendations and decide whether to implement them based upon your particular requirements and Droplet use cases. This program is currently in Private Preview, meaning functionality is experimental and subject to change.

3. Data Usage and Privacy

By opting into the Droplet Troubleshooting Agent Private Preview program, you authorize DigitalOcean to access your Droplet logs, metrics, and system metadata with OpenAI-based language models to generate insights into performance issues and service outages. Moreover, you authorize DigitalOcean to collect Usage Data (including session activity, how you engage with responses, and how you use select services). All Droplet logs, metrics and system metadata will be used solely for the purpose of generating insights and recommendations that may enhance the performance and reliability of your Droplet. All Usage Data will be used solely for the purpose of internal tracking and making improvements to the Services.

  • Service Subprocessor: DigitalOcean uses Traversal (Located in USA - NY) to support delivery of the Preview Offering. A current list of DigitalOcean Service subprocessors is available here.

4. Data Security

  • DigitalOcean is committed to ensuring the security and confidentiality of your data by implementing industry-standard security measures to protect your interaction data during transmission and storage while using Droplet Troubleshooting Agent.
  • However, you acknowledge that despite our efforts, no method of data transmission or storage is completely secure, and DigitalOcean does not guarantee absolute security.

5. Accuracy of AI-Generated Insights

Droplet Troubleshooting Agent aims to provide useful insights into Droplet performance issues; however, you acknowledge and accept that:

  • The insights generated by AI may not always be accurate, complete, or up to date.
  • AI recommendations are based on the analysis of the data provided and are for informational purposes only. It is your responsibility to validate and act on any insights or recommendations.
  • DigitalOcean is not liable for any actions taken, by you or anyone on your behalf, based on the AI-generated insights.

6. Private Preview Program Limitation of Liability

  • Droplet Troubleshooting Agent is offered on an ‘as-is’ and ‘as available’ basis during the Private Preview phase. DigitalOcean does not guarantee that the feature will be error-free or that it will meet your specific requirements.
  • DigitalOcean shall not be held liable for any damages, losses, or costs arising from the use or inability to use Droplet Troubleshooting Agent, including any failure to generate insights or inaccuracies in the generated insights.
  • Your participation in the Private Preview program is voluntary, and you acknowledge that Droplet Troubleshooting Agent is still under development, which may result in occasional interruptions, errors, or changes in the functionality of the feature.

7. Opt-Out and Termination

  • You may opt out of the Droplet Troubleshooting Agent Private Preview program at any time by turning off the feature preview from your account settings. Upon opting out, DigitalOcean will cease collecting your data for AI insights
  • DigitalOcean reserves the right to terminate or modify the Droplet Troubleshooting Agent Private Preview program at its discretion at any time upon informing you in writing. Upon conclusion of the Private Preview, information in the “Droplet Troubleshooting” tab may no longer be available.

8. Feedback and Improvements

  • As a participant in the Droplet Troubleshooting Agent Private Preview program, you may be invited to provide feedback to help improve the service. The feedback will be gathered with an aim to improve the feature for you and other customers. You grant DigitalOcean the right to use your feedback without any obligation to you.
  • Your participation and feedback during the Private Preview phase will help us refine Droplet Troubleshooting Agent and prepare it for a broader release.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction identified in the DigitalOcean Terms of Service without regard to its conflict of law principles.

10. Acceptance of Terms Again

By opting into the Droplet Troubleshooting Agent Private Preview program, you acknowledge that you have read, understood, and agree to be bound by these additional terms and conditions.
