The below terms (the “Private Preview Terms”) apply to your participation in the Private Preview of, and your use of, a preliminary, limited-availability release of the DigitalOcean Managed Weaviate offering (the “Preview Offering”). The Private Preview Terms supplement the terms of the DigitalOcean Terms of Service Agreement, including Service Terms, or such other written agreement between you and DigitalOcean governing your use of our Services (our “Agreement”). The Preview Offering is a Beta Service for purposes of the Agreement, and terms not defined in these Private Preview Terms have such meaning otherwise defined in the Agreement. If there is a conflict between these Private Preview Terms and the Agreement, these Private Preview Terms will control solely with respect to the conflict relating to your use of the Preview Offering.
Subprocessor Disclosure: DigitalOcean uses Amazon Web Services, Cloudflare, and Traversal (located in the United States) as subprocessors to support delivery of the Preview Offering service. A current list of other DigitalOcean Service subprocessors is available here.
Your participation in the Private Review and use of the Preview Offering is voluntary. If you do not accept these Private Preview Terms then you may not participate in the Private Preview.
The Preview Offering is a preliminary, limited-availability release of a DigitalOcean Service. This offering is intended for testing, evaluation, and feedback purposes.
2.1 Pre-Production Only: The Preview Offering service is provided “AS-IS” and “AS-AVAILABLE” and is intended strictly for non-production, test-only workloads. You acknowledge the experimental nature of AI-integrated features (including automated vectorization, re-ranking, and RAG modules) and that DigitalOcean may modify, suspend, or discontinue AI functionalities at any time without notice.
2.2 Private Preview Pricing: This Preview Offering is provided at no charge during the Private Preview. DigitalOcean reserves the right to change pricing upon 15 days’ notice.
2.3 Support: No formal Technical Support or Service Level Agreements (SLAs) apply. There are no uptime, performance, or availability guarantees. Existing DigitalOcean SLAs do not apply.
2.4 Third-Party AI Integration: The Service utilizes third-party AI models (e.g., from providers like OpenAI, Google, or Anthropic) to process data. By enabling these modules, you authorize the transmission of data to these providers. Your use is subject to their respective terms and privacy policies as outlined in the AI Model Terms and Terms of Service Agreement, including Service Terms DigitalOcean is not responsible for the accuracy, availability, or security of third-party AI models.
3.1 Input Data and AI Accuracy: You are responsible for the data you input into the Preview Offering. Do not input personally identifiable, confidential, or highly regulated information (e.g., HIPAA-protected data). You acknowledge that AI-generated outputs, including search results and summaries, are probabilistic and may contain inaccuracies, omissions, or “hallucinations.” You are solely responsible for verifying the accuracy of AI-generated content before relying on it.
3.2 Non-Training Commitment: DigitalOcean does not use Customer Data (including vectors or metadata stored within Weaviate) to train, retrain, or improve its own underlying machine learning models or those of third-party providers, unless explicitly initiated by you (e.g., through fine-tuning modules) or opted into by separate agreement.
3.3 Improvement: By using the Preview Offering, you authorize DigitalOcean to use technical metadata (e.g., latency, error rates, usage frequency) and any Feedback you provide to improve our infrastructure and the Preview Offering.
3.4 Credential Management: You are responsible for the security and management of any third-party API keys or credentials provided to the Service. Any usage fees incurred through these third-party keys are your sole responsibility.
4.1 DigitalOcean will provide a minimum of 15 days notice regarding the termination or conclusion of this Preview Offering.
4.2 If the Preview Offering advances to a subsequent release cycle (Public Preview or General Availability), DigitalOcean will endeavor to assist Customer with the migration of their data and resources. Notwithstanding this, DigitalOcean reserves the right, in its sole discretion, to purge all customer data and terminate the Preview Offering instance at the conclusion of the Preview Offering or at any time thereafter, regardless of any planned transition or migration.
DigitalOcean may suspend or terminate your access to the Preview Offering at any time (in our sole discretion), with or without notice, if: (a) we choose to discontinue the Preview Offering or transition it to Public Preview or General Availability; or (b) we believe your use violates these Preview Terms and related agreements.
AS A BETA SERVICE, THE PREVIEW OFFERING IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITALOCEAN DISCLAIMS ALL WARRANTIES, AND OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THE PREVIEW OFFERING WILL NOT EXCEED $100.
