The below terms (the “Preview Terms”) apply to your participation in the public preview of, and your use of, the above identified DigitalOcean Service (the “Preview Offering”). The Preview Terms supplement the terms of the DigitalOcean Terms of Service Agreement or such other written agreement between you and DigitalOcean governing your use of our Services (our “Agreement”). The Preview Offering is a Beta Service for purposes of the Agreement, and terms not defined in these Preview Terms have such meaning otherwise defined in the Agreement. If there is a conflict between these Preview Terms and the Agreement, these Preview Terms will control solely with respect to the conflict relating to your use of the Preview Offering.
Subprocessor Disclosure: DigitalOcean uses Amazon Web Services, Cloudflare, and Traversal (located in the United States) as subprocessors to support delivery of the Preview Offering service. A current list of other DigitalOcean Service subprocessors is available here.
Your participation in the public preview and use of the preview offering is voluntary. If you do not accept these Preview Terms then you may not participate in the public preview.
The Preview Offering provides access to a hosted inference endpoint for the MiniMax-M2.5 model, a text-to-text AI model developed by MiniMax AI. This offering is intended for testing, evaluation, and feedback purposes.
Preview Pricing: As specified in the Gradient AI Platform Pricing page during the preview period. DigitalOcean reserves the right to change pricing upon 30 days’ notice.
Support: No formal Technical Support or Service Level Agreements (SLAs) apply. Support is provided on a reasonable-effort basis during standard business hours (8:00 AM – 5:00 PM PT, Monday through Friday, excluding holidays).
Model Source: Powered by the MiniMax-M2.5 model (developed by MiniMax AI).
Regional Availability: Available in select data centers as indicated in the creation flow.
Your use of the Preview Offering is subject to the following third-party requirements:
Model License: The MiniMax-M2.5 model is provided under the MiniMax Model License. You agree to comply with all terms therein.
Attribution: If you redistribute any Output from the model or incorporate the model into a derivative product, you must retain the following attribution: “MiniMax AI model is licensed under the MiniMax Model License, Copyright © MiniMax. All Rights Reserved.”
Prohibited Uses: In addition to the the DigitalOcean Acceptable Use Policy, use is conditioned upon compliance with the Minimax Prohibited Use Policy, wherein you agree you will not use, or allow others to use, the Models or any derivatives of the Models to:
Violate any applicable federal, state, local, or international law or regulation, or infringe upon the lawful rights or interests of any third party.
Assist with, engage in or otherwise support any military purpose.
Exploit, harm, or attempt to exploit or harm minors in any way.
Generate or disseminate false or misleading information with the intent to cause harm.
Generate or disseminate content prohibited by applicable laws or regulations.
Generate or disseminate personally identifiable information without proper authorization or for unlawful or unreasonable purposes.
Defame, disparage, harass, or cause harm to any individual or entity.
Conduct fully automated decision-making that adversely affects an individual’s legal rights or creates or modifies a binding, enforceable obligation.
Promote discrimination, hate speech, or harmful behavior against individuals or groups based on race or ethnic origin, religion, disability, age, nationality and national origin, veteran status, sexual orientation, gender or gender identity, caste, immigration status, or any other characteristic that is associated with systemic discrimination or marginalization.
While we expect that the Preview Offering will perform for some production-level workloads, as set forth in the Agreement, and without limiting any disclaimers in the Agreement, you acknowledge that:
As a Beta Service the Preview Offering may not meet the same reliability, performance, or security standards as generally available Services, and may not be appropriate for all production workloads.
You are solely responsible for determining whether and how to use the Preview Offering, and that you should test and validate it in your environment before relying on it for any production workloads.
We recommend that you initially use simulated test data with the Preview Offering and not include personally identifying, confidential, regulated, or high-risk information. You remain responsible for configuring and using the Services appropriately and for taking your own steps to maintain appropriate security, protection, and backup of your data.
Input Data: You are responsible for the data you input into the Preview Offering. We recommend using simulated test data. Do not input personally identifiable, confidential, or highly regulated information (e.g., HIPAA-protected data).
Model Training: Unless otherwise opted-in via a separate agreement, DigitalOcean does not use your input or output data to train the underlying MiniMax-M2.5 model.
Improvement: By using the Preview Offering, you authorize DigitalOcean to use technical metadata (e.g., latency, error rates, usage frequency) and any Feedback you provide to improve our infrastructure and the Preview Offering.
Accuracy: Outputs generated by AI models may be inaccurate, incomplete, or biased. You must independently verify all outputs before relying on them for any business or production use.
No Fiduciary Duty: The Preview Offering is a tool; it does not provide professional advice (legal, medical, or otherwise).
Non-Exclusivity: You acknowledge that other users may receive similar or identical outputs from the model based on similar inputs.
DigitalOcean may suspend or terminate your access to the Preview Offering at any time (in our sole discretion), with or without notice, if:
We choose to discontinue the Preview Offering or transition it to General Availability.
We believe your use violates these Preview Terms or the MiniMax Model License.
The third-party model provider (MiniMax) modifies their license or availability in a manner we believe impacts our ability to provide the service.
AS A BETA SERVICE, THE PREVIEW OFFERING IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITALOCEAN DISCLAIMS ALL WARRANTIES, AND OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THE PREVIEW OFFERING WILL NOT EXCEED $100.
